My lawyer said it will cost too much to collect the debt and my accountant suggested we write it off - is that true?
Horses for Courses! We collect for numerous legal & accountancy practices for both their internal debts and on behalf of their clients. Regrettably the legal fraternity are adept at securing Judgment but when it comes to collection, litigation is not always appropriate. If your debt is bona fide you reserve the right to be paid!
This is good/preferential customer and I don't want to upset them?
We find a WIN:WIN. Oftentimes you are not paid because your customer is also waiting on payment from their clients; we work laterally to ensure that if we can be of assistance to your customer in recoveries all parties win.
What if the company is in Receivership/Liquidation, can you help?
If the debt was incurred by a Company without a Personal Guarantee then NO. NZCML can provide complete Credit Control policies i.e. Term & Conditions, Credit Application and Personal Guarantee's etc to future proof your business. This allows you to mange better your business and to know who you are dealing with.
I don't have Terms of Trade - does that matter?
This is one of the most important documents you need in place to avoid disputes but as part of a sound Credit Control Policy. Without it you could be breaching the Fair Trading Act by attempting to collect costs from you debtor in which case you will be responsible for our recovery fees and/or costs as a deductible charge from your debt. We can draft and mould both Terms and Policies around the way you work, drawing on your uniqueness and your industry standards/compliancy. Be wary of generic terms of trade.
What do you actually do?
We are not traditional debt collectors. Normally debt recovery actions consist of phone calls and posting letters. NZCML are not Debt collectors, we are Mediators. We work with you and your debtor to resolve outstanding accounts. We also offer invaluable insight into the future integrity of your business by maximizing the services of loss prevention, debt collection, tracing and investigations. We can also recover debt you may have written off.
When do I have to pay you?
If you have the correct Terms & Conditions in place your debtor should be responsible for the costs on which basis we return you 100% of the debt. Should the debtor enter into an arrangement or pay you after lodgment of any instruction you may be responsible for the fees or commission due to NZCML.
What happens now?
Once we receive the Authority to Act from you, we begin the process as outlined. The debt is now NZCML's and all communication will cease between you and your debtor. The debt now is NZCML responsibility and if the Debtor tries to communicate with you we encourage our clients to refer them back to NZCML. Payments are made to NZCML trust account and a Cheque or online transfer is made once we receive payment.
